SEPHORA “SURVEY-FOR-A-CHANCE-TO-WIN” SWEEPSTAKES OFFICIAL RULES
Official Rules
1. No Purchase Necessary to Enter or Win.
The SEPHORA “Survey-For-a-Chance-to-Win” Sweepstakes (the “Sweepstakes”) is a series of monthly sweepstakes. Sweepstakes is void outside of Canada, and where prohibited or restricted by law. Sweepstakes is subject to applicable federal, provincial and local laws.
2. The Sweepstakes begins at 12:00:01 a.m. Pacific Time (“PT”) on January 1, 2024 and ends on December 31, 2024 at 11:59:59 p.m. PT (the “Sweepstakes Period”).
During the Sweepstakes Period, SEPHORA will conduct 12 monthly sweepstakes (each a “Monthly Sweepstakes”). Each Monthly Sweepstakes will begin at 12:00:01 a.m. PT on the first day of each month during the Sweepstakes Period and will end at 11:59:59 p.m. PT on the last day of that month (the “Monthly Sweepstakes Period”). Sweepstakes is sponsored by Sephora USA, Inc., (“Sponsor”) 525 Market Street, 32nd Floor, San Francisco, CA 94105 and administered by Medallia, Inc., 450 Concar Dr, San Mateo, CA 94402 and U.S. Sweepstakes & Fulfillment Co., 625 Panorama Trail, Suite 2100, Rochester, NY 14625 (Medallia and U.S. Sweepstakes collectively, “Sweepstakes Administrator”, and collectively with the Sponsor “Sweepstakes Entities”).
3. Eligibility
Sweepstakes is open only to current legal residents of Canada who have reached the age of majority in the Province or Territory in which they reside as of the date of entry. Sweepstakes is not open to employees, shareholders, officers, directors, agents or representatives of Sweepstakes Entities or of Sweepstakes Entities’ parents, affiliates, subsidiaries, agents, and/or representatives, each person or entity connected with the production, administration or judging of the Sweepstakes, and the immediate family members (mother, father, brother, sister, daughter, son or spouse, regardless of where they live) of and those domiciled with (whether or not related) any of the foregoing.
4. How do I enter?
You may enter the Sweepstakes in the following two (2) ways (described in more detail below): (a) by completing an online survey OR (b) by entering online without completing the survey. There is a limit of one (1) entry per person for each Monthly Sweepstakes regardless of method of entry; use of multiple email addresses prohibited.
(a) Online Survey Entries
During the Sweepstakes Period, you may visit the webpage located at http://survey.medallia.com/sephora/canada and complete the online survey. Upon completion of the survey you will be given the option of entering the Sweepstakes by completing the online entry form. To complete the online entry form, provide all required information (your full name, daytime telephone number, and a valid e-mail address), and submit your entry according to the directions on the screen. By completing and submitting the form as described, you will receive one (1) entry into the Monthly Sweepstakes that corresponds to the Monthly Sweepstakes Period in which your entry was received (see Rule 2).
(b) Online Entry (Without Survey)
During the Sweepstakes Period, you may also enter online by visiting the webpage located at http://survey.medallia.com/?sephoraswsca&unit=222. Follow the Sweepstakes link, complete your online entry form by providing all required information (your full name, daytime telephone number, and a valid e-mail address), and submit your entry according to the directions on the screen. By completing and submitting the form as described, you will receive one (1) entry into the Monthly Sweepstakes that corresponds to the Monthly Sweepstakes Period in which your entry was received (see Rule 2).
For all online entries (survey and non-survey):
Entries must be received by Sweepstakes Administrator by the end of the applicable Monthly Sweepstakes Period in order to be entered into the applicable Monthly Sweepstakes (see Rule 2). Timing of entry receipt will be determined by Sweepstakes Administrator’s time clock. Each entry is only eligible for the Monthly Sweepstakes corresponding to the Monthly Sweepstakes Period in which the entry was received and will not be entered into subsequent Monthly Sweepstakes, if any. No hand or e-mail deliveries of entries will be accepted. Sweepstakes Entities are not responsible for late, lost, delayed, stolen, incomplete, falsified, void, corrupted, garbled, misdirected, or otherwise unintelligible entries or for any problems, bugs or malfunctions you may encounter when submitting your entry. Incomplete, garbled, corrupted or otherwise illegible entries are void and will not be accepted. Sweepstakes Entities reserve the right to disqualify incomplete entries. Only one (1) entrant’s name may appear on an entry. In the event of a dispute as to the identity of the person submitting an entry, the entry will be deemed to be submitted by the authorized account holder of the e-mail address at the time of entry and such individual must comply with these official rules. “Authorized account holder” is the natural person who is assigned the e-mail address by the internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail in question. Online entries must be made by the original, manual keystrokes of the individual entrant. Proof of sending an entry is not proof of receipt by Sweepstakes Entities. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
5. Selection and notification of winners
Each eligible entry received during a Monthly Sweepstakes Period will be entered into the random drawing for the prize available for that Monthly Sweepstakes (see Rules 2 and 6). The random drawing for each Monthly Sweepstakes will be conducted at U.S. Sweepstakes & Fulfillment Co., 625 Panorama Trail, Suite 2100, Rochester, NY 14625 at approximately 12:00 p.m. (noon) PT on the 15th of the month following the end of the applicable Monthly Sweepstakes Period (each, a “Drawing Date”). On each of the Drawing Dates, one entrant will be selected at random by a representative of Sweepstakes Entities from all eligible entries received during the applicable Monthly Sweepstakes Period.
Attempts will be made to contact selected entrants by phone and/or e-mail. All selected entrants will be required to respond (as directed) to the phone and/or e-mail notification within (5) business days of the first attempt made to contact him/her. Before being confirmed as a prize winner, selected entrant (a) must correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by e-mail or by telephone at a pre-arranged, mutually convenient time, at Sponsor’s discretion; (b) may be required to execute and return a liability / publicity release (“Release”) within the time specified therein confirming compliance with the Official Rules, accepting the prize as awarded, releasing the Releasees (as defined in Rule 9) from any liability in connection with the Sweepstakes and, except where prohibited by law, allowing Sponsor to use his/her name, image, likeness, hometown name and/or prize information as set out in Rule 9; and (c) must otherwise be in compliance with the Official Rules. If a selected entrant: (i) cannot be reached within the time prescribed; (ii) fails (if required) to complete and return Release within the time specified; (iii) fails to correctly answer the skill-testing question; (iv) cannot accept or receive the prize for any reason; or (v) is otherwise not in compliance with the Official Rules, he/she/they will be disqualified, he/she will not receive any prize and an alternate entrant will be randomly selected in accordance with the Official Rules from among the remaining eligible entries until such time as a winner is confirmed for that prize. Prizes will be delivered to confirmed winners.
6. Prizes
At the outset of the Sweepstakes, there will be a total of twelve (12) Prizes available to be won. One (1) Prize will be available for each Monthly Sweepstakes. The Prize is a $250 CDN Sephora gift card (value $250 CDN).
Total value of all Prizes available during the Sweepstakes Period is $3,000 CDN. There is no limit on the number of Prizes that may be won by any one entrant during the Sweepstakes. Prizes are redeemable only at Sephora retail stores in Canada and online at the sephora.com website and cannot be redeemed outside of Canada or through a catalog order. Prizes are subject to the terms and conditions applicable to the Sephora gift card, are non-refundable and non-transferable, cannot be combined with any other special offer or promotion and must be accepted as awarded. Prizes may not be exchanged for cash value or substituted, except that Sponsor, in its sole discretion, reserves the right in its sole discretion to substitute a prize with either the cash value of the prize, or a prize or prizes of equal or greater value. Applicable taxes (if any) and any other costs or expenses associated with the prizes or the use thereof not expressly stated as being part of the prize are the sole responsibility of the winner.
7. Odds
The odds of winning a Prize for a given Monthly Sweepstakes depend on the total number of eligible entries received during the applicable Monthly Sweepstakes Period.
General Conditions
8. Sweepstakes is subject to these Official Rules. By participating, entrants agree to be bound by these Official Rules which can be found at //www.medallia.com/sweepstakes/sephoracanada/. All decisions of Sweepstakes Entities are final and binding and entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules, except where prohibited by law. Sweepstakes Entities reserve the right in their sole discretion to disqualify any entrant they find to be tampering with the entry process or the operation of the Sweepstakes or violating these Official Rules.
The Sweepstakes Entities assume no responsibility for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, void, corrupted, garbled or unintelligible entries, communications or Releases, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind, including damage to an entrant’s or any other person’s computer or other property, caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes, or (vi) any other errors whether caused by any equipment or programming associated with or utilized in the Sweepstakes or any technical or human error that may occur in the processing of entries in the Sweepstakes.
LIMITATION OF LIABILITY: IN NO EVENT WILL ANY SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, ANY PRIZES WON, ENTRANT’S ACCESS TO OR USE OF ANY OF SEPHORA’S OR MEDALLIA’S WEB SITE, OR THE ACCESSING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITES. NOT APPLICABLE IN QC AND SK: WITHOUT LIMITING THE FOREGOING, EVERYTHING ON SEPHORA’S AND MEDALLIA’S WEB SITES ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES OR CONDITIONS SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
9. By accepting a prize in this Sweepstakes, each winner grants to Sponsor, where permitted by law, the right to use and publish (worldwide and via the Internet) winner’s name, image, likeness, hometown name and/or prize information for advertising, trade and promotional purposes without notification, review or approval, and without additional consideration.
Release and Indemnification: BY ACCEPTING A PRIZE, EACH WINNER AGREES TO RELEASE AND INDEMNIFY SWEEPSTAKES ENTITIES, THEIR ATTORNEYS, AFFILIATES, TOGETHER WITH THE RESPECTIVE DIRECTORS, EMPLOYEES, OFFICERS, LICENSEES, LICENSORS AND AGENTS OF EACH, INCLUDING WITHOUT LIMITATION, THEIR RESPECTIVE ADVERTISING AND PROMOTION ENTITIES AND ANY PERSON OR ENTITY ASSOCIATED WITH THE PRODUCTION, JUDGING, OR ADMINISTRATION OF THE SWEEPSTAKES, (COLLECTIVELY, THE “RELEASEES”) FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, ARISING FROM OR IN CONNECTION WITH AWARDING, RECEIPT, POSSESSION, USE OR MISUSE OF ANY PRIZE, PARTICIPATION IN THIS SWEEPSTAKES, OR ANY SWEEPSTAKES-RELATED ACTIVITIES.
10. Sweepstakes Entities reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes for any reason, including but not limited to, if the Sweepstakes is not capable of running as planned because of circumstances including, but not limited to, a virus, bug, computer problem, unauthorized intervention, fraud, technical failures or other causes beyond Sweepstakes Entities’ control, corrupt the administration, security, fair administration or proper play of the Sweepstakes, without prior notice. Sweepstakes Entities may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine such entrant is tampering with the entry process or attempting to undermine the legitimate operation of the Sweepstakes in any way by cheating, hacking, deception, or any other unfair playing practices, or otherwise violating these Official Rules. Use of any automated system including robotic or form filling software to enter or participate is strictly prohibited and will result in disqualification. Sweepstakes Entities may disqualify, at their sole discretion, any entries they believe are created by an automated system. Disputes regarding these Official Rules and/or this Sweepstakes will be governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. Any and all legal actions or claims arising in connection with this Sweepstakes shall be adjudicated in the applicable court in Toronto, Ontario.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OR FAIR PLAY OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL, IF DISCOVERED, RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
12. Privacy
By entering the Sweepstakes, entrants consent to the collection, use and disclosure of their personal information by the Sweepstakes Entities for the purposes of administering the Sweepstakes, contacting selected entrants and otherwise as permitted or required by law and in accordance with Sponsor’s privacy policy available at https://www.sephora.com/beauty/privacy-policy.
